- Expression of Interest are invited for Legal Advisory Firm Statement of needs HEKS/EPER is looking for a local law firm in DR Congo with sworn lawyers who can offer legal services from January 1, 2024 to December 31, 2024. The law firm will be responsible in particular for the following missions, for HEKS/EPER . 1. Check the legal compliance of local employee management manuals; has. Review the employee handbook and ensure compliance with labor laws in DR Congo; b. Provide answers to legal questions related to labor law in DR Congo. 2. Provide HEKS/EPER with legal advice on the application and interpretation of the texts in force; 3. Provide templates for labor law-related documents in accordance with local legislation (agreements, offer letters, termination letters, etc.); 4. Represent HEKS/EPER before courts and other government entities, as necessary; 5. Take all steps with public or private organizations with a view to bringing to a successful conclusion the procedures initiated or to be initiated; 6. Review legal documents, including leases, contracts with suppliers and consultants, memorandums of understanding and other agreements; 7. Make available to HEKS/EPER as part of legal and tax monitoring, legal and regulatory texts or any other update relating to the legal and/or tax field and linked to the activities of international NGOs in the DRC ; 8. Draft, negotiate and conclude, if necessary, any document with legal and/or contractual value that HEKS/EPER may be required to sign with third parties, including its employees, beneficiaries, partners, service providers or suppliers; 9. Undertake, on behalf of HEKS/EPER, the recovery of principal, interest, commissions, disbursements and any costs, of the debts of which the organization will communicate the file to the Cabinet; 10. Represent HEKS/EPER in court both at the pre-judicial investigation phase and at the jurisdictional phase as plaintiff or defendant; 11. The firm will provide an ad hoc report if necessary and a report every quarter on the status of the current files that it is monitoring. Qualifications: • Law firm duly registered with the Bar in DR Congo; • Minimum of 10 (ten) years of experience in the practice of law in DR Congo; • Five (5) years of experience providing legal advice to international organizations, non-governmental organizations or foreign entities; • Experience in representing international organizations before local courts (legal cases); • Proven experience in the field of INGO taxation; • Experience in obtaining various official operating or administrative facilitation documents (framework agreements, interministerial decrees, registration certificates, legal personality); • Fluency in local languages and French required.
